The central idea of the work is the question of whether and to what extent patients with advanced cancer have the right to legally demand a palliative treatment whose efficacy has not been proven from the point of view of the desired objectives. The book demonstrates how hope cannot be subject to legal protection and, also, that, even if theoretical-legal reasons were not sufficient for the absence of an abstract right to hope, ethical reasons would be. The work concludes that the best palliative care, rather than palliative treatment, guarantees the best right to health for advanced cancer patients, especially in terminal cases. In addition to this theoretical discussion, the book also presents the results of a qualitative research the author conducted with 48 advanced cancer patients in Brazil and Germany to investigate their expectations towards chemotherapy. This study has confirmed that many patients decide to undergo often toxic and exhausting treatments, unrealistically believing that their cancer is curable or that, as long as they continue with a course of chemotherapy, cancer may be beaten. Privacy is an unwieldy concept that has eluded an essentialised definition despite its centrality and importance in the body of bioethics. The compilation presented in this volume represents continuing discussions on the theme of privacy in the context of genetic information. It is intended to present a wide range of expert opinion in which the notion of privacy is examined from many perspectives, in different contexts and imperatives, and in different societies, with the hope of advancing an understanding of privacy through the examination and critique of some of its evolving component concepts such as notions of what constitute the personal, the context of privacy, the significance and impact of the relational interests of others who may share the same genetic inheritance, and mechanisms for the protection of privacy (as well as of their limitations), among others. It is hard to avoid hearing about genetic testing. It is advertised, discussed, debated, and offered to patients. Some are over the counter, such as paternity testing, testing for risk for diabetes and others. We look forward to curing disease and alleviating suffering--for our children as well as for ourselves--but we also worry about delving too deeply into the double helix. Abuses perpetrated by eugenicists--from involuntary sterilization to murder--continue to taint our feelings about genetic screening. Yet, as Ruth Schwartz Cowan reveals, modern genetic screening has been practiced since 1960, benefiting millions of women and children all over the world. The Censor's Hand: The Misregulation of Human-Subject Research by
Medical and social progress depend on research with human subjects. When that research is done in institutions getting federal money, it is regulated (often minutely) by federally required and supervised bureaucracies called "institutional review boards" (IRBs). Do -- can -- these IRBs do more harm than good? In The Censor's Hand, Schneider addresses this crucial but long-unasked question. Schneider answers the question by consulting a critical but ignored experience -- the law's learning about regulation -- and by amassing empirical evidence that is scattered around many literatures. He concludes that IRBs were fundamentally misconceived. Their usefulness to human subjects is doubtful, but they clearly delay, distort, and deter research that can save people's lives, soothe their suffering, and enhance their welfare. IRBs demonstrably make decisions poorly. They cannot be expected to make decisions well, for they lack the expertise, ethical principles, legal rules, effective procedures, and accountability essential to good regulation. And IRBs are censors in the place censorship is most damaging -- universities. In sum, Schneider argues that IRBs are bad regulation that inescapably do more harm than good. They were an irreparable mistake that should be abandoned so that research can be conducted properly and regulated sensibly.

Working from within the contours of Christian faith, this book examines the relation between two ways of forming families--through nature (by procreation) and through history (by adoption). Christians honor the biological tie between parents and children, for it is the work of God in creation. Yet Christians cannot forget that it is adoption, and not simply natural descent, that is at the center of the New Testament's depiction of God's grace. Gilbert Meilaender takes up a range of issues raised by the practice of adoption, always seeking to do justice to both nature and history in the formation of families, while keeping at the center of our vision the truth that it is not by nature but by grace that we can become adopted children of the one whom Jesus called his Father. An ever-increasing demand for organs, with over 100,000 people on waiting lists, has driven a relentless search for new sources of organs. In 1995 the American Medical Association supported taking organs from anencephalic infants, children born without brains. In 1999 the Chinese government began removing organs from members of the politically outcast religious group Falun Gong, making a lucrative profit from sales to foreigners. Recently in Belgium physicians have euthanized a patient by removing her organs. The search for fresh organs began much earlier, in 1968, when death was redefined, so that well-preserved organs could be removed from brain dead individuals. The early 1990s saw the introduction of donation after cardiac death, in which organs are taken from individuals whose hearts could still be resuscitated. Over the last two decades various countries have attempted markets in the sale of organs. Each of these sources of organs raises ethical concerns. Embryonic stem cell research holds unique promise for developing therapies for currently incurable diseases and conditions, and for important biomedical research. However, the process through which embryonic stem cells are obtained involves the destruction of early human embryos. KatrienDevolder focuses on the tension between the popular view that an embryo should never be deliberately harmed or destroyed, and the view that embryonic stem cell research, because of its enormous promise, must go forward. She provides an in-depth ethical analysis of the major philosophical andpolitical attempts to resolve this tension. One such attempt involves the development of a middle ground position, which accepts only types or aspects of embryonic stem cell research deemed compatible with the view that the embryo has a significant moral status. An example is the position that itcan be permissible to derive stem cells from embryos left over from in vitro fertilisation but not from embryos created for research. Others have advocated a technical solution. Several techniques have been proposed for deriving embryonic stem cells, or their functional equivalents, without harming embryos. An example is the induced pluripotent stem cell technique. Through highlighting inconsistencies in the arguments for these positions, Devolder argues that the centraltension in the embryonic stem cell debate remains unresolved. This conclusion has important implications for the stem cell debate, as well as for policies inspired by this debate.
